Terms of use

These Terms of Use (“Terms”) govern access to and use of mobile applications, websites, and related services published by Ahmet Oğuz Şahan (“we”, “us”) (collectively, the “Services”). By downloading, accessing, or using the Services you agree to them. If you do not agree, do not use the Services.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services on devices you own or control, for your own non-commercial use, subject to these Terms and to the rules of the app store you downloaded from. You may not copy, sell, rent, sub-licence, decompile or reverse engineer the Services except where that restriction is prohibited by law.

2. Who may use the Services

You must be at least 13 years old to use the Services, and at least 16 where the law of your country sets that as the minimum age for consenting to online services without a parent. You must also be old enough to form a binding contract where you live. Some apps state a higher age in their store listing; where they do, that age applies.

If you are under the age of majority, you may only use the Services with the involvement of a parent or legal guardian, who is responsible for your use of them and agrees to these Terms on your behalf.

You may not use the Services if:

  • you are below the applicable minimum age;
  • we have previously terminated your account or barred you, whether or not you use a new email address, device or identity;
  • you are barred from receiving services under sanctions or export laws that apply to us;
  • you are legally prohibited from using social or messaging services, including where a court order or a registration requirement arising from an offence against a child restricts you from doing so.

If we learn that an account belongs to someone below the minimum age, we close it and delete its data. If you believe a child has an account, tell us at apparyaofficial@gmail.com.

3. Accounts and your responsibility

Register with accurate details, keep your credentials confidential, and do not share your account or let anyone else use it. You are responsible for everything done through your account, including what you send to other people, and for any harm or loss it causes them or us. Tell us promptly if you believe your account has been used without your permission.

MovieHub connects you with other people: friends you add, and people matched to you by shared taste. Treat them as you would anyone else. Nothing about this service makes another user safe, honest or who they claim to be, and you decide what you disclose and to whom.

4. Your content

You keep ownership of what you create in the Services — messages, lists, ratings, photos and anything else you submit (“Your Content”). You grant us a limited licence to host, store, reproduce and transmit Your Content solely to operate the Services: to deliver a message to its recipient, to show your list on your profile, to back it up and to restore it. We do not use Your Content to advertise to other people, and we claim no ownership of it.

You are responsible for Your Content and confirm you have the right to submit it. Do not upload anything that infringes someone else’s rights.

5. Prohibited conduct

There is zero tolerance for objectionable content and abusive behaviour. The rules below are not exhaustive, and conduct does not have to be illegal to break them. You may not use the Services to do, or to help anyone else do, any of the following.

Harm to children

  • Share, request, or link to child sexual abuse material, or any sexualised depiction of a minor, real or generated.
  • Contact a minor for sexual purposes, or attempt to establish that kind of contact (grooming).
  • Solicit nude or sexual images from anyone, or share them with a minor.

We report child sexual abuse material to the relevant authorities and preserve the account data associated with it. There is no appeal from this.

Harassment, hate and violence

  • Harass, bully, stalk, intimidate, or send repeated unwanted contact, including after being blocked.
  • Threaten violence, or wish, encourage or celebrate harm against a person or group.
  • Attack people on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity or sexual orientation.
  • Promote or glorify terrorism, violent extremism, or a violent organisation.
  • Encourage suicide, self-harm, or disordered eating.

Sexual content and privacy

  • Send unsolicited sexual content, or pornography of any kind.
  • Share intimate images of a person without their consent, or threaten to.
  • Publish another person’s private information — home address, phone number, identity documents, financial details, workplace — without their consent (doxxing).
  • Record, photograph or forward a private conversation in a way its participants would not expect.

Deception and fraud

  • Impersonate another person, a company, or us, or misrepresent your identity or age.
  • Run any scam, phishing attempt, romance or investment fraud, or request money under false pretences.
  • Send spam, bulk or automated messages, chain messages, or unsolicited promotion.
  • Sell, buy, or transfer accounts, or manufacture accounts in bulk.

Illegal and regulated activity

  • Arrange or promote the sale of drugs, weapons, stolen goods, counterfeits, or any other restricted item.
  • Coordinate or facilitate trafficking, exploitation, or any criminal offence.
  • Infringe copyright, trade marks, or any other right, including by sharing pirated film sources.

Technical abuse

  • Access accounts, data or systems that are not yours, or attempt to.
  • Distribute malware, or interfere with, overload, or disrupt the Services.
  • Scrape, harvest or bulk-collect data about users, or use bots or automated clients against the Services.
  • Circumvent blocks, bans, age gates, rate limits, or any other safeguard.
  • Reverse engineer the Services except where that restriction is prohibited by law.

6. Reporting, blocking and moderation

Every user can block another user, which stops further contact and hides their activity, and can report content or behaviour from within the app. We review reports of objectionable content and act within 24 hours — removing the content, and suspending or terminating the account responsible where warranted. We may also review content proactively. We are not obliged to monitor everything users send, and we do not promise to find everything that breaks these rules.

7. Enforcement and consequences

Where we conclude that these Terms have been broken, we may, depending on what happened:

  • remove or restrict the content;
  • limit features, or suspend the account temporarily;
  • terminate the account permanently and delete its content;
  • refuse to let the person register again, and keep the minimum record needed to enforce that;
  • preserve relevant account data where we reasonably believe it is evidence of a crime or is needed to establish or defend a legal claim.

Serious cases — including anything in “Harm to children”, credible threats of violence, and fraud — result in immediate termination without warning. Termination for breach does not entitle you to a refund of any subscription, and does not release you from liability for what you did. Where we can lawfully do so we will tell you what happened and how to appeal, by writing to apparyaofficial@gmail.com.

8. Cooperation with law enforcement

We may preserve and disclose account information, content and technical records — including registration details, IP addresses and message content — to police, courts, regulators or other competent authorities where we are legally required to, where we receive a valid legal request, or where we believe in good faith that disclosure is necessary to prevent or investigate a serious crime, to protect a person from death or serious harm, or to establish or defend legal claims.

Where the law allows it and no one is endangered by the delay, we try to notify the account holder. Where the law forbids notice, or a child’s safety is at stake, we do not. How this is handled as a data protection matter is set out in our Privacy policy.

9. Subscriptions and purchases

Some Services offer optional paid subscriptions. Price, billing period and what is included are shown before you confirm. Purchases are processed by the app store, not by us: payment is charged to your store account, a subscription renews automatically unless auto-renew is switched off at least 24 hours before the period ends, and renewal is charged within 24 hours of the period ending. Manage or cancel a subscription in your App Store or Google Play account settings — uninstalling the app does not cancel it. Refunds are handled by the app store under its own policy; we cannot issue them on the store’s behalf. Any free trial ends immediately if you buy a subscription.

10. Advertising

Some Services show advertising, including optional rewarded ads you choose to watch in exchange for a feature. Ads come from third-party networks and are subject to those networks’ policies. See our Privacy policy for how tracking permission is requested and what happens if you decline.

11. Third-party content and services

The Services display information from third parties and link to places we do not control. In particular, MovieHub uses film data from The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. We do not warrant third-party content, and your use of a linked service is governed by that service’s own terms.

12. Availability and changes

We may change, suspend or discontinue any part of the Services, and we may impose limits on features or storage. We aim to give notice of material changes where it is reasonable to do so. The Services are provided on an as-available basis and may be interrupted for maintenance, updates or causes beyond our control.

13. Disclaimers

To the fullest extent permitted by law the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted or error-free. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by law.

14. Limitation of liability

To the fullest extent permitted by law we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our aggregate liability arising out of the Services is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty euros. Nothing here limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited by law.

15. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your misuse of the Services, Your Content, or your breach of these Terms or of another person’s rights.

16. Intellectual property

The Services, including software, design, text, graphics and the app names and logos, belong to us or our licensors and are protected by intellectual property law. These Terms grant you no rights in our trade marks.

17. Suspension and termination

You may stop using the Services and delete your account at any time — see Account & data deletion. We may suspend or terminate access where these Terms are breached, where required by law, or where continuing would expose users or us to harm. Clauses that by their nature should survive termination do so.

18. Apple App Store

Where you obtain an app from Apple, these Terms are between you and us, not Apple; Apple is not responsible for the app or its content, has no obligation to provide support or handle claims relating to it, and is a third-party beneficiary entitled to enforce these Terms against you.

19. Changes to these Terms

We may update these Terms. The date at the top reflects the current version, and continued use after a material change takes effect means you accept it. If you do not accept the change, stop using the Services.

20. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Ahmet Oğuz Şahan is resident, without regard to conflict-of-law rules, and without prejudice to mandatory consumer protections in your country of residence. Disputes go to the competent courts of that jurisdiction, unless consumer law gives you the right to bring a claim where you live.
